These Terms of Use (“Terms”) govern your access to and use of the website operated by Freedom Insurance Solutions (“Freedom,” “we,” “us,” or “our”) and any forms, content, and communications made available through it (the “Site”). By using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
1. Who we are
Freedom is an insurance agency and brokerage. We are not an insurance company. Insurance products are underwritten and issued by independent insurance carriers, and coverage availability varies by state, carrier, and underwriting eligibility. Products may not be available in all jurisdictions.
2. Informational content only
Site content, including coverage descriptions, industry pages, and articles, is general information and is not legal, tax, accounting, financial, or coverage advice. It is not a substitute for reviewing an actual policy. Coverage is determined solely by the terms, conditions, limits, endorsements, and exclusions of the policy issued. In any conflict between the Site and a policy, the policy controls.
3. No binding of coverage
Submitting a quote request, contact form, or document does not bind, change, renew, or cancel coverage, and does not create a client or fiduciary relationship. Coverage is not in effect until confirmed in writing by Freedom or the issuing carrier and any required premium is paid. Quotes are estimates based on the information provided and are subject to carrier underwriting, verification, and approval. Premiums and terms may change.
4. Your information and responsibilities
- You represent that information you submit is accurate, complete, and that you are authorized to submit it on behalf of the business.
- You understand that misstatements or omissions may affect quotes, eligibility, or coverage, including rescission of a policy.
- You will not upload content you do not have the right to share, or that contains malware or unlawful material.
5. Consent to communications
By submitting a form, you agree that Freedom may contact you at the phone number and email address provided, including by calls and text messages that may use automated technology, regarding your inquiry and insurance needs. Consent is not required to purchase insurance. Message and data rates may apply. Reply STOP to opt out of texts at any time.
6. Compensation disclosure
Freedom is typically compensated through commissions paid by insurance carriers and may, where permitted by law, receive fees, contingent or supplemental compensation, or other remuneration. Information about our compensation is available upon request.
7. Acceptable use
You agree not to: use the Site unlawfully or fraudulently; interfere with its security or operation; scrape, harvest, or collect data by automated means; submit false or spam submissions; or attempt to gain unauthorized access to any system.
8. Intellectual property
The Site and its content, design, text, graphics, logos, and trademarks are owned by or licensed to Freedom and are protected by law. You may view and print pages for personal, non-commercial business reference. No other use is permitted without our prior written consent.
9. Third-party links and services
The Site may link to third-party websites, including carriers. We do not control and are not responsible for their content, policies, or practices. Access is at your own risk.
10. Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FREEDOM AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR BUSINESS, ARISING FROM YOUR USE OF OR RELIANCE ON THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). This section does not limit obligations under an insurance policy or any duty that cannot be limited by law.
12. Indemnification
You agree to indemnify and hold harmless Freedom and its owners, officers, employees, and agents from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site, your violation of these Terms, or inaccurate information you submit.
13. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute relating to the Site or these Terms will be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to their jurisdiction. To the extent permitted by law, disputes will be brought only on an individual basis and not as part of a class or representative action. Any claim relating to the Site must be brought within one year after it arises.
14. Changes and termination
We may modify these Terms or the Site at any time. Changes are effective when posted, and continued use constitutes acceptance. We may suspend or restrict access to the Site at our discretion.
15. General
If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement regarding the Site.
